A stalemate happens when a player cannot make any move that does not put their king into check. If the king is not in check and there are no legal moves on the board for the player on the move, it is stalemate. The simple answer is, if the king in check and there is no way out of check (moving out of check, interposing between the king and the checking piece, or taking the checking piece), it is checkmate.
